‘Elegance’ Terrace Ridge Circle, Davenport FL33896 (‘the property’)

All bookings are subject to the following terms and conditions. If any terms are not fully understood, please contact us for further information before signing the booking form.

1. Booking and payments

1.1 Guests should contact us to check price and availability.

1.2 The booking is valid after:

a) The booking form has been completed and signed and received by us.

b) The booking has been confirmed by us to the Guest.

c) The reservation deposit of £100 per week has been received.

Please note this deposit is non-refundable

1.3 Provisional bookings will be held for 7 days during which time we must receive your completed booking form and reservation deposit.

1.4 The person who signs the booking form (‘the Guest’) must be a member of the party occupying the property and must be 21 years of age or over. The Guest warrants that he or she is authorised to agree booking terms and conditions on behalf of the parties on the booking form (‘the occupiers’ which expression includes ‘the Guest’).

1.5 The balance must be paid 10 weeks prior to the date you arrive at the condo and any booking made within this period is due in full at the time of booking.

1.6 The owner’s are stated on the rental booking form.

2. What's included

2.1 You have the use of the property including all utilities and Terrace Ridge community facilities. The property is cleaned and prepared for your arrival, and it is therefore up to you to keep the property clean and to change and wash bed linen and towels (which are supplied) during your stay. The property is available for occupation from 4.00pm on the first day of rental period and must be vacated by 11.00am on the day of departure.

2.2. No animals or pets are allowed in the condo.

2.3. Our condo is non-smoking

2.4. We cannot guarantee that all the facilities described will always be available, although all the descriptions are made in good faith.

3. Security deposit

3.1 We understand that accidents do happen, but we ask that you inform our Management Company of any defects or breakages as soon as possible and pay for the repair or replacement so that neither you nor the following guests are inconvenienced. A security deposit of £200 must be paid at the time of the balance payment i.e. 10 weeks prior to the date you arrive at the condo. The security deposit will be returned to the Guest within 6 weeks, providing the management company reports no loss, damage or excessive cleaning.

3.2 In the event any loss, damage or replacement exceeds the security deposit, the Guest agrees to pay any extra amount within 30 days. All loss and damage is the responsibility of the Guest.

3.3 The Guest agrees to take good care of the property and leave it in a clean and tidy condition at the end of the rental period. The Guest also agrees to take all reasonable security measures to ensure the safety of the occupiers and the Owner’s possessions, during the rental period.

4. Unavoidable Changes

We reserve the right to enter the property at any reasonable time to inspect it, or to carry out repairs. (If such repairs are necessary all reasonable measures will be taken not to inconvenience the occupier’s). We reserve the right to cancel the booking if such repairs or work need to be carried out in your rental period if required in the interest of relevant Health & Safety legislation. In this event, we will return all sums (but without interest or compensation) or at the option of the Guest and subject to availability will endeavour to offer alternative premises of comparable standard.

5. Cancellation

5.1 You may cancel the booking at any time subject to cancellation charges. You may be able to alter your booking, but this may incur an extra charge.

5.2 The Guest needs to inform us, in writing, of any cancellation and we reserve the right to cancel the booking if payment has not been received on agreed dates.

5.3 Cancellation charges are as follows:

Any cancellation 10 weeks or more prior to arrival date – loss of reservation deposit. 30-69 days – 50% of the rental charge Less than 30 days – 100% of the rental charge

6. Force majeure

The owners or their representatives accept no liability whatsoever for events which are 'force majeure' These include but are not limited to war, threat of war, riots, civil commotion, terrorist attacks, industrial disputes, natural or nuclear disaster, flood, fire, adverse weather conditions, technical problems, delays or cancellations of transport or any other events beyond our control.

7. Liability

7.1 We accept no liability whether direct or indirect (including but without limitation consequential loss) sustained by occupier’s or any other visitors to the property, including all Terrace Ridge community facilities, or any loss or damage howsoever caused to any occupier’s property brought to the property.

7.2 No liability is accepted by the owners for the loss of main services or failure of appliances, nor for the consequences of the actions or omissions of persons who may control supply of mains services, nor any actions taken in the vicinity of the property by any person or authority over which there is no control by the owners.

8. Insurance

It is vital that you have adequate comprehensive insurance cover for you and all members of your party. Check that any policies you are considering do in fact cover you for rented accommodation booked independently of travel arrangements. No responsibility is accepted for any death, illness or loss or damage to property and/or motor vehicles howsoever caused.

9. In case of complaint

Complaints or problems should be reported to the owners representative immediately so that they can be dealt with promptly. We will not accept liability for any dissatisfaction or other complaint not reported to the managing agent during your stay. Any occupier’s who have caused / are causing damage, distress, danger, annoyance, nuisance or disturbance to any neighbours or other residents in the vicinity are liable to be asked to leave or be evicted. Such action will not entitle the occupier’s or any of them to a refund of any monies. Occupiers must be aware that the owner accepts no responsibility for any noise that may occur due to any building works. It is possible that some construction work may take place in the area, as this is a new development.

10. Subletting

The accommodation is reserved exclusively for the occupier’s named on the booking form and no other persons whatsoever are permitted to stay there unless this has been agreed with the owners in advance. The US management company may evict or request to leave, any persons not authorized to stay in the property.

THIS CONTRACT IS GOVERNED BY AND SHALL BE INTERPRETED IN ACCORDANCE WITH ENGLISH LAW
